This Privacy Policy describes how we collect, use, disclose, and protect information when you visit momentiv.ai (the “Site”), contact us, or use our services. By using the Site, you agree to this Policy.

2. What We Collect

We collect information you provide, information collected automatically, and information from third parties.

  • Identifiers and contact details: name, email, phone, company, role, message content.
  • Commercial information: services of interest, proposals, transactions (if applicable).
  • Internet and activity data: IP address, device/browser type, pages viewed, time on page, referring pages, and similar analytics.
  • Approximate geolocation inferred from IP.
  • Professional information you choose to share.
  • Inferences drawn to improve the Site, services, and marketing.

3. How We Collect It

  • Directly from you via website forms, email, phone, consultations, and scheduling.
  • Automatically via cookies, pixels, and similar technologies (see “Cookies and Similar Technologies”).
  • From third parties (e.g., scheduling, CRM, analytics/ads platforms, referral partners, and publicly available sources).

4. How We Use Information

  • Operate, maintain, and improve the Site and services.
  • Respond to inquiries, schedule calls, deliver proposals, and provide support.
  • Analyze Site performance and user behavior.
  • Market and advertise our services, including retargeting/remarketing.
  • Detect, prevent, and address security, fraud, or technical issues.

5. Our Current Tools and Vendors (Dynamic)

Our tool stack may change over time. We aim to keep this section current; the categories of data below map to Section 2.

  • CRM and field service management platforms (e.g., GoHighLevel, Jobber, Housecall Pro, ServiceTitan): lead management, customer records, job tracking, and communication workflows.

  • Automation platforms (e.g., Make, Zapier, n8n): workflow automation connecting business tools and processing data between systems.

  • AI Service Providers:
    Anthropic (Claude) and OpenAI (ChatGPT): we may use AI tools to draft, summarize, analyze non-sensitive inputs (e.g., website copy drafts, support macros, operational workflows). We limit what we send, avoid unnecessary personal data, and use available provider controls to restrict training where offered.

Note:We do not sell personal information for money. We may “share” certain personal information for targeted advertising as defined by certain U.S. state privacy laws (see Section 10). SMS opt-in data and consent information are excluded from all such sharing and are never used for targeted advertising, sold, or shared with third parties for marketing or promotional purposes.

6. Legal Bases (EEA/UK)

If you are in the EEA/UK, we process personal data under: consent, contract performance, legitimate interests (e.g., improving services, securing the Site, marketing to existing/prospective business customers), and legal obligations.

7. How We Disclose Information

  • SMS data exclusion: SMS opt-in data is expressly excluded from the disclosures in this section. We do not disclose mobile information or SMS consent data to third parties or affiliates for their marketing or promotional purposes. SMS data is only shared with subcontractors and service providers who operate the messaging service on our behalf, and only to the extent necessary to deliver that service.
  • Service providers/processors: hosting, form handling, analytics, scheduling, email delivery, storage, customer support, outreach, advertising, and payments (if used, e.g., Square/Stripe).
  • Advertising and analytics partners: to measure performance and personalize/measure ads.
  • Business transfers: in connection with a merger, acquisition, financing, or sale.
  • Legal and safety: to comply with law or protect rights, safety, and security.

8. Cookies and Similar Technologies

We and our partners use cookies, pixels, and similar tech to operate the Site, analyze traffic, remember preferences, and personalize/measure ads. You can manage cookies through your browser settings and through our on-site cookie consent controls. Disabling some cookies may affect functionality.

9. Retention

We retain personal information only as long as necessary for the purposes in this Policy, to comply with legal obligations, resolve disputes, and enforce agreements. Retention periods vary by data type and business need.

10. Your Privacy Rights

Depending on your location, you may have rights to access, correct, delete, port, restrict/object, and withdraw consent. You may also opt out of targeted advertising or “sharing” and the sale of personal information (as defined by applicable state laws).

Request by emailing privacy@momentiv.ai. We may verify your request. If denied, you may appeal by replying to our decision. EEA/UK residents may lodge a complaint with a supervisory authority.

U.S. State Disclosures (e.g., California CPRA, Colorado, Connecticut, Virginia, Utah)

  • Notice at collection: We collect the categories in Section 2 for the purposes in Section 4 and disclose as in Section 7.
  • Sensitive data: We do not seek to collect sensitive personal information.
  • Sale/Sharing: We do not sell personal information for money. We may share certain personal information for targeted advertising; you can opt out by emailing privacy@momentiv.ai. Mobile information, SMS opt-in data, and SMS consent records are excluded from any sharing for targeted advertising and are never disclosed to third parties or affiliates for marketing or promotional purposes.
  • Non-discrimination: We will not discriminate against you for exercising your privacy rights.
  • Ads choices: Use your browser controls; platform preferences (e.g., Google Ads Settings, Meta Ad Preferences); and industry opt-outs (e.g., DAA/NAI). Some choices rely on cookies. Clear them and you may need to opt out again.

11. AI and Automated Decision-Making

We use AI tools (Section 5) to assist human staff with drafting, summarization, and internal workflows. We do not use fully automated decision-making that produces legal or similarly significant effects without human involvement.

12. Security

We use reasonable administrative, technical, and organizational safeguards appropriate to our business. No method of transmission or storage is 100% secure.

13. Data Breach Notification

In the event of a data breach involving your personal information, we will notify you and any applicable regulatory authorities as required by law.

14. International Transfers

We are based in the United States and may process data in countries that may not offer the same level of protection as your jurisdiction. Where required, we implement appropriate safeguards (e.g., Standard Contractual Clauses).

15. Children's Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child provided personal information, contact us to request deletion.

16. Third-Party Links

We may link to third-party sites or services. Their privacy practices are governed by their own policies.

17. Do Not Track

We currently do not respond to browser “Do Not Track” signals. Use the choices in this Policy to control cookies and advertising preferences.

18. SMS Communications

Momentiv LLC operates two distinct types of SMS messaging: operational messaging sent directly to our business clients, and customer-facing messaging sent through systems we build and operate on behalf of those clients. Each is described below.

18.1 Operational Messaging for Business Clients

Business owners who engage Momentiv LLC for services may receive operational SMS messages as part of their service agreement. These messages may include:

  • Daily operational briefings
  • Lead notifications and alerts
  • Responses to status requests and commands
  • Service-related updates and coordination

Consent: Business clients consent to receive operational SMS messages as part of their service agreement with Momentiv LLC. Consent to receive SMS messages is not required to access our services or complete a transaction.

Opting out: Business clients may opt out at any time by replying STOP to any message, or by contacting privacy@momentiv.ai.

18.2 Customer-Facing Messaging via Client Businesses

If you have opted in to receive SMS messages from a business that uses Momentiv services, you may receive communications from that business, including:

  • Responses to your service inquiry
  • Appointment confirmations and reminders
  • Follow-up messages regarding your inquiry or completed service
  • Review requests after service completion

All messages identify the sending business by name in the sender field or message body.

Consent: You will only receive SMS messages if you have explicitly opted in through one of the following methods:

  • Texting a business number: By sending an SMS to a business that uses our services, you provide express consent to receive reply messages related to your inquiry. No messages are sent to a number that has not first texted the business.
  • Submitting a website contact form with SMS consent: Business websites powered by our services include an SMS consent checkbox with the disclosure: “I agree to receive SMS messages from [Business Name] regarding my service inquiry. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe.” Consent is recorded with a timestamp.
  • Providing your phone number during a call: If you call a business and provide your mobile number for follow-up, your verbal consent is logged and you may receive SMS messages related to your inquiry.

Contacting a business through other channels (such as email or third-party platforms) does not constitute consent to receive SMS messages. Consent to receive SMS messages is not required to access services or complete a transaction.

Opting out: You may opt out at any time by replying STOP to any message. Once you opt out, no further messages will be sent unless you initiate contact again. Reply HELP for assistance.

18.3 SMS Data Sharing

No mobile information, SMS opt-in data, or consent data will be shared with third parties or affiliates for marketing or promotional purposes. This information is excluded from all other data-sharing practices described in this Privacy Policy.

SMS opt-in data and consent records may only be shared with subcontractors or service providers acting on our behalf, and solely to the extent necessary to deliver the messaging service you have opted into. This includes our SMS platform provider (Twilio), call tracking providers, and CRM systems used to operate the messaging program. These parties are contractually bound to protect your information and may not use it for their own marketing or promotional purposes.

SMS opt-in data is not used for targeted advertising, is not sold, and is not shared with advertising or analytics partners under any circumstances.

18.4 Message Frequency and Costs

Message frequency varies based on your interaction. Standard message and data rates may apply depending on your mobile carrier and plan.

19. Changes to This Policy

We may update this Policy periodically. The “Last updated” date reflects the latest revision. Material changes will be posted here.
